In the Name of God Amen  I Henry Smith of Hanslop in the County of Bucks Yeoman being weak in Body but of sound and disposing mind memory and understanding praised be God for the same do make publish and declare this to be my last Will and Testament in manner and form following that is to say   ffirst I Give devise and bequeath unto my Son William Smith all that my Messuage or Tenement with the two Closes of Pasture Ground situate and being in Ratliffe cum Chackmore in the County of Bucks with all other my Closes Hereditaments    and Premises situate and being in the said parish of Ratliffe cum Chackmore To hold  the same to my said Son William Smith his heirs Executors Administrators and Assigns for ever   I give and devise unto my Son Henry Smith all those my three acres and a half of Copyhold Land lying in Gawcott ffields within the Manor of the Preb end of Buckingham with Gawcott and all other my Copyhold Lands and premises lying within the said Manor which I have duly surrendered to the use of this my Will To hold the same to my said Son Henry Smith his heirs and assigns for ever   I give and devise all that my Messuage or Tenement with the Closes thereto adjoining situate at Piddington in the County of Northampton and all other my hereditaments and premises situate and lying in Piddington aforesaid unto my ffriend Thomas Kitelee of Castlethorpe in the said County of Bucks Gentleman my said Son Henry Smith and my Son in law William Burt and to the Survivors and Survivor of them and to the heirs and Assigns of such Survivor upon Trust and confidence nevertheless that they the said Thomas Kitelee Henry Smith and William Burt and the Survivors and Survivor of them and the heirs of such Survivor do and shall receive the Rents Issues and Profits thereof and pay and apply the same in such manner so they shall see most proper to and for the use and benefit of my Daughter Eleanor Smith for and during the Term of her natural life and from and after the decease of my said Daughter Eleanor Smith I give and devise [all] and singular the said premises at Piddington aforesaid with the appurtenances unto all and every the children of my said Daughter Eleanor Smith lawfully begotten to take as Tenants in common and not as joint Tenants But if my said Daughter Eleanor Smith shall happen to die without Issue of her Body lawfully begotten living at the time of her decease my mind and will is and I hereby give and devise all and singular my said Estate and Premises at Piddington unto and amongst my said Sons William Smith Henry Smith and my Daughter Sarah the Wife of the said William Burt and my Daughter Elizabeth Sear and to their several heirs and assigns for ever to take as Tenants in common and not as joint Tenants I give and bequeath unto my said Son Henry Smith the Lease of the ffarm and premises which I now occupy of Edward Watts Esquire To hold the same for and during all the residue and remainder of the Term that shall be to come therein at the time of my decease   to and for his own proper use and benefit I give and bequeath to my said Son William Smith the Legacy or Sum of One hundred pounds   I give and bequeath to my said Daughter Elizabeth Sear the Legacy or Sum of Two hundred pounds together with my best Tea Table and one half part of all my Silver Spoons marked with the Letters E.S.    I give and bequeath to my ffriend the said Thomas Kitelee and my said Son Henry Smith  and to the Survivors and Survivor of them and to the Executors and Administrators of such Survivor the Sum of One hundred pounds upon Trust that they place the same out on good and sufficient Security and pay the Interest and proceeds thereof into the hands of my Daughter Sarah the Wife of the said William Burt for and during the Term of her natural life and I direct that the Receipt of her my said Daughter notwithstanding her Coverture shall be a sufficient discharge to the said Thomas Kitelee and Henry Smith and the Survivors of them for the same and from and after the decease of my said Daughter Sarah Burt I direct the said Sum of One hundred pounds to be paid unto and amongst all and every the child and children of my said Daughter Sarah Burt in equal shares and proportions   I give to my said Daughter Sarah Burt my best Mahogany Dining Table to and for her own proper use and benefit   I give and bequeath to my said Daughter Eleanor Smith the Legacy or Sum of One hundred and fifty pounds to be paid to her at such times in such proportions and in such manner as my Executors hereinafter named shall think proper  I also give unto my said Daughter Eleanor Smith my best Bedstead and ffurniture ffeather Bed Quilt pair of Blankets and pair of Sheets and one Servants Bed one small Tea Table one small Mahogany ffolding Table the Eight Day Clock standing down Stairs the six best Chairs and the remaining half part of all my Silver Spoons marked with the Letters E.S.  I give to the said Thomas Kitelee the Sum of Ten pounds for the trouble he may have in the Execution of this my Will I give to William Bradbury now living with me the Legacy of ffive Guineas as a token for his faithful Service   All the rest and residue of my household ffurniture Horses Cows Sheep Cattle Corn Hay ffarm and Dairy Stock and all other Good Chattels and Effects which I shall be possessed of at the time of my decease I direct the same to be sold by my Executors hereinafter named as soon as conveniently may be after my decease by Public Auction or otherwise as to them shall seem most proper and by and out of the Moneys arising therefrom together with all the rest residue and remainder of my Personal Estate Money Securities for Money and other Effects which I shall be entitled unto at the time of my decease and which I hereby give and bequeath to them I direct all my legal Debts ffuneral Expenses the Legacies hereinbefore by me given and all other charges attending the Execution of this my last Will to be fully paid and satisfied and from and after payment thereof I give and bequeath all such residue of my Personal Property unto and amongst my said Son Henry Smith and my said Daughters Sarah the Wife of the said William Burt and Elizabeth Sear to be equally divided between them share and share alike and I direct the part and share of my said Daughter Sarah Burt shall not be liable to the Debts Contol or Engagements of her present or any future husband with whom she may Intermarry but that her Receipt alone shall be to my Executors from time to time a sufficient discharge for the same And I do hereby nominate and appoint my ffriend the said Thomas Kitelee my said Son Henry Smith my said Son in law William Burt and my said Daughter Elizabeth Sear Executors and Executrix of this my last Will and Testament and my mind and will is that my said Trustees Executors and Executrix and the Survivors and Survivor of them and the heirs Executors and Administrators of such Survivor shall and may in the first place and at all times and retained to themselves herself and himself respectively out of the said Trust Moneys and Premises all such Costs Charges Damages and Expenses as they or either of them shall  at any time expend lay out and be put unto for or by reason or reason of all any or either of the Trusts hereby respectively in them reposed and neither of them shall be answerable for any loss or misapplication which may happen to the said Trust Monies or Premises unless such loss or misapplication shall happen through the manifest wilful neglect or mismanagement of them or either of them  nor shall they or either of them be answerable for the acts Deeds or Defaults of the other or others of them but each of them for his or her own acts or Deeds respectively nor shall they or either of them be accountable or responsible for any more of the said Trust  Monies or Premises than shall actually come to his or her hands respectively by virtue of this my last Will  And I do hereby revoke and make void all former Wills by me at any time or times heretofore made and do declare this only to be my last Will and Testament  In Witness whereof I have to this my last Will and contained in three sheets of paper and affixed together at the top by a Seal similar to the Seal affixed to this last sheet thereof to the first and second sheets thereof set my hand and to this third and last sheet my hand and Seal this Twenty second day of August in the year of our Lord One thousand seven hundred and Ninety one  Henry Smith  Signed Sealed published and declared by the
