This is the last Will and Testament of me William Hillyer the Elder of Hanslop in the County of Bucks Yeoman which I make in manner following (that is to say)   First I will and direct that all my legal debts and funeral Expences shall be fully paid and discharged   Next I Give devise and bequeath unto my Brother Thomas Hillyer of Stony Stratford in the said County of Bucks Baker any my brother in law Richard Kilpin of Stoke Goldington in the said County of Bucks Yeoman All and every my Messuages Cottages Closes Lands tenements hereditaments and Real Estate whatsoever situate and being at Hanslopp aforesaid or elsewhere and also all and singular my Goods Chattels Cattle stock ready money bonds notes securities for money and personal Estate and effects whatsoever and wheresoever and of what nature sort or kind soever To Hold my said real and personal Estates unto them the said Thomas Hillyer and Richard Kilpin their Heirs Executors and Administrators Upon special trust and Confidence that they my said trustees or the survivor of them or the Heirs Executors Administrators or Assigns of such Survivor do and shall with all Convenient speed after my decease make sale and dispose of all my said Messuages Cottages Closes Lands tenements hereditaments and real Estate and also of all my said Goods Chattels Cattle stock and personal Estate and Effects (Not then already in money) and do and shall Collect and get in all debts and sums of money whatsoever due and owing to me at the time of my decease and after converting the whole of my said real and personal Estates into money and thereout retaining and reimbursing themselves and himself all Costs charges and Expences attending such sales and collection of debts and also thereout discharging all my Legal debts and funeral Expences and the costs of proving this my Will Then upon further trust and Confidence that they my said trustees or the survivor of them or the Executors or administrator of such survivor do and shall bring all the residue of the monies then remaining into one purse and pay and divide the same unto amongst and between all and every my Sons and Daughters William Hillyer Thomas Hillyer Richard Hillyer Samuel Hillyer Elizabeth the wife of Joseph Atterbury Susannah the wife of Thomas Cliff Mary the wife of Thomas Gilling Sarah Hillyer and Ann Hillyer share and share alike (Except only with respect to such of my Children to or for whose use and benefit I have already or shall hereafter advance any sum or sums of money and which said sum or sums of money so advanced or to be  advanced and by me written down and mentioned in a schedule to be found with this my Will or for which any Note receipt or Memorandum shall be formed I do hereby will and direct shall be taken into the account of the residue of my personal Estate and be considered as part of the fortune of him her or them for whose use the same shall have been so advanced in my life time my intention being that each of my Children shall receive an Equal fortune from me and if any or either of my said Children shall depart this life in my life time and shall leave any child or Children then I will and direct that the share of him her or them so dying and leaving Child or Children shall go and be paid to such his her or their Child or Children and not to my surviving Sons and Daughters and if any or either of my said Sons and Daughters shall depart this life before any division of my said property shall take place and leave no such Child or Children then the share of him her or them so dying without Issue shall sink into the General fund for the benefit of my other Children   And for facilitating the sale of my said Messages Cottages Closes Lands Tenements Hereditaments and real Estate I do hereby declare that the receipt or receipts of my said trustees or the survivor of them or the Heirs or Assigns of such survivor shall be good and sufficient discharge and discharges to the purchaser or purchasers of the same or any part or parts thereof for as much money as in such receipt or receipts shall be expressed to be received and that from and after the signing of such receipt or receipts the purchaser or purchasers of my said real or any parts thereof shall be absolutely discharged therefrom and shall not be obliged to see to the application of the said trust monies or any part thereof or be answerable for the nonapplication thereof And that they my said trustees or either of them shall not be charged with any loss of the said trust monies or any part thereof but such only as shall happen through their wilful neglect or defaults nor one of them be answerable or accountable for the other of them but each of them for his and their own acts receipts neglects or defaults only   And I Do Hereby Appoint my said Brother and Brother in law Thomas Hillyer and Richard Kilpin joint Executors of this my Will and Testament and Guardians of all my Children who shall be in the minorities at the time of my Decease and apply and dispose of their fortunes during such minorities as they shall think proper   And Lastly I do hereby revoke and make void all former and other Wills and do declare this only to be my last Will and Testament In Witness whereof I the said William Hillyer the testator have to this my last Will and Testament contained in two sheets of paper fixed together at the top with a seal set my hand and seal (that is to say) to the first sheet hereof my hand only and to this last sheet my hand and seal the twenty ninth day of December in the year
