This is the last Will and Testament of me William Cleaver of Hanslope in the County of Buckingham Gentleman being in sound mind memory and understanding First I will order and direct that all my just debts funeral and testamentary expenses shall be paid by my Executors hereinafter named I give and bequeath unto my daughter Sarah Cleaver in case she shall remain single and be living with me at the time of my decease all and singular my household goods furniture plate linen china and all other my household Effects whatsoever to and for her own use and benefit absolutely and Whereas I have advanced to my daughter and the wife of William Ratliffe of Burkhill in the said County of Buckingham Innkeeper to my daughter Hannah the widow of the late Henry Osborn deceased and to my sons Joseph Cleaver and Thomas Cleaver the sum of two hundred pounds a piece and also to others of my children the various sums of money hereinafter mentioned Now my Will and devise is that such of my children should have an equal share of my property and therefore I give and bequeath unto my friend Richard Rogers of Hanslope aforesaid farmer and Edward Augustine Worley of Stony Stratford in the said County of Buckingham Gentleman their executors and administrators all and singular my monies and securities for money book debts rights credits goods chattels and personal Estate and Effects whatsoever and wheresoever not hereinbefore disposed of To hold the same to them the said Richard Rogers and Edward Augustine Worley their executors and administrators Upon Trust that they the said Richard Rogers and Edward Augustine Worley or the survivors of them or the executors or administrators of such survivors do and shall sell and dispose of my said personal Estate as shall not consist of moneys or Debts (except as before excepted) and which shall not be invested in stock or government securities for the best price or prices that can be reasonably obtained for the same and shall and do collect such debts and my Will is and I do direct that my said Trustees or the survivor of them or their executors or administrators of such survivor do and shall stand possessed of and interested in the aforesaid monies arising by sale or sales of my said personal Estate and Effects hereby made saleable as also such Debts ready money sum and sums of money out upon security Upon Trust in the first place that they the said Richard Rogers and Edward Augustine Worley or the survivor of them or their executors or administrators of such survivor do and shall thereout and therewith pay satisfy and discharge all my just debts funeral and testamentary expenses and all other incidental expenses attending such sale or sales aforesaid and after payment thereof then Upon Trust that they my said Trustees or the survivor of them or the executors or administrators of such survivor shall and do divide and pay the remainder thereof in the proportions and manner following that is to say First I give and bequeath to my said Edward Cleaver the Sum of twenty six pounds in addition to the sum of one and Seventy four pounds already advanced to him to and for his own use and benefit absolutely also I give and bequeath to my Son Richard Cleaver the sum of sixty pounds in addition to the sum of one hundred and forty pounds already advanced to him to and for his own use and benefit absolutely Also I give and bequeath unto my Son Matthew Cleaver the sum of twenty six pounds in addition to the sum of one hundred and seventy four pounds already advanced to him to and for his own use and benefit absolutely Also I give and bequeath unto my daughter Esther the wife of John Lattimer the sum of one hundred and fifty pounds in addition to the sum of fifty pounds already advanced for her own use and benefit also I give and bequeath to my daughter Mary Dolton the wife of John Dolton of Bradwell the sum of one hundred and eighty pounds in addition to the sum of twenty pounds already advanced to her to and for her own use and benefit absolutely Also I give and bequeath unto my daughters Elizabeth Cleaver Martha Cleaver and Sarah Cleaver the sum of two hundred pounds apiece to and for their several and respective use and benefit absolutely all which said several legacies I do direct shall be paid and payable to my said Sons and Daughters respectively within twelve calendar months next after my decease and after payment of the aforesaid legacies then upon Trust that they my said Trustees the said Richard Rogers and Edward Augustine Worley and the survivor of them or the Executors and administrators of such survivor do and shall pay and divide the Residue and Remainder of my said personal Estate then in their hands Unto all and every my children that is to say Ann Ratliffe Hannah Osborn Joseph Cleaver Thomas Cleaver Edward Cleaver Richard Cleaver Matthew Cleaver Esther Lattimer Mary Dolton Elizabeth Cleaver Martha Cleaver and Sarah Cleaver equally between and amongst them share and [share] alike to whom I give and bequeath the same to and for their own several and respective use and benefit absolutely and I give and devise unto the said Richard Rogers and Edward Augustine Worley all such real Estates as are now or shall at any time hereafter become vested in me Upon any Trust or Trusts whatsoever To hold the same to them the said Richard Rogers and Edward Augustine Worley and the survivor of them and the heirs and assigns of such survivor upon the trusts affecting the said Estates respectively and my Will further is and I do hereby direct that my said Trustees or either of them or their or either of their executors or administrators shall not be charged or chargeable with any more of the said trust monies and premises than they respectively shall actually receive and that one of them shall not be answerable or accountable for the other of them but each one for their own acts receipts rights or defaults only nor shall they or either of them be answerable or accountable for any Banker broker or other person with whom any of the said trust monies may be deposited for safe custody or otherwise in the execution of the said trusts nor for the insufficiency or deficiency of any stocks funds or securities in or upon which any of the said trust monies may be invested or for any other misfortune loss or damage which may happen in the execution of the aforesaid trusts or otherwise in relation thereto unless the same shall happen by or through their own wilful fault respectively and also that they my said Trustees shall and may by and out of the monies which shall come to their respective hands by virtue of the trusts aforesaid retain to and reimburse himself and themselves and be allowed all costs charges and expenses which they or either of them may respectively sustain expend or be put unto in or about the execution of the Trusts aforesaid or in matter relating thereto and I do hereby nominate and appoint my said friend Richard Rogers and the said Edward Augustine Worley joint Executors of this my Will And lastly I do hereby revoke all former wills and testamentary instruments by me at any time heretofore made and declare this only to be and contain my last Will and Testament in Witness whereof I the said William Cleaver the Testator have to this my last Will and Testament contained in four sheets of paper and to each sheet thereof set my hand and seal this twelfth day of June one thousand eight hundred and twenty nine Wm. Whereas I William Cleaver of Hanslope in the County of Buckingham Gentleman have in and by my last Will and Testament bearing date the twelfth day of June one thousand eight hundred and twenty nine nominated and appointed Richard Rogers and Edward Augustine Worley Executors of my said Will Now it is my Will and desire that my son Thomas Cleaver of Hanslope farmer should be appointed an Executor conjointly with the said Richard Rogers and Edward Augustine Worley I do therefore hereby nominate and appoint the said Thomas Cleaver an Executor of my said Will conjointly with the said Richard Rogers and Edward Augustine Worley And Whereas I have since the date and execution of my said Will advanced my said son Richard the sum of fifteen pounds and to my said Daughter Mary Dolton the sum of thirty pounds now I do hereby direct my said Executors to deduct the said two sums of ffifteen pounds and thirty pounds from the respective legacies by my said Will bequeathed to them and I do hereby ratify and confirm my said Will in all other respects and do declare this to be a Codicil thereto In Witness thereof I the said William Cleaver the Testator have hereunto set my hand and seal this first day of June one thousand eight hundred and thirty one Wm.Cleaver (L.S.) Whereas I William Cleaver of Hanslope in the County of Buckingham Gentleman have in and by my last Will and Testament bearing date the twelfth day of June one thousand eight hundred and twenty nine given and bequeathed unto my Daughter Sarah Cleaver in case she should remain single and being living with me at the time of my decease all and singular my household goods and furniture plate linen china and all other my household effects whatsoever to and for her own use and benefit absolutely Now I do by this my Codicil which I declare as part of my last Will and Testament revoke the said bequest to my said daughter Sarah Cleaver and instead thereof give and bequeath the same unto Richard Rogers Edward Augustine Worley and Thomas Cleaver the Executors named in my said Will and Codicil Upon Trust that they the said Richard Rogers Edward Augustine Worley and the said Thomas Cleaver or the survivor of them or the Executors or administrators of such survivor do and shall sell and dispose of the same and stand possessed of and interested in the monies arising therefrom Upon the same Trusts as are mentioned and declared in my said Will and in lieu and recompense for such household goods and furniture I give and bequeath to my said daughter Sarah Cleaver the sum of one hundred pounds for her own absolute use and benefit in addition to what I have hereinbefore given to her in and by my said Will and I do hereby in all other respects confirm my said Will in Witness whereof I the said William Cleaver the Testator have hereunto set my hand and seal the fifteenth day of August one thousand eight hundred and thirty two Wim Cleaver (L.S.)
