This is the last Will and Testament of me Thomas Billing of Hanslope in the County of Buckingham Carpenter First I will order and direct that all my just Debts funeral and testamentary Expenses shall be fully paid and satisfied I give and bequeath all my Working Tools which I use in my business as a Carpenter unto my Nephew Thomas Allen the Son of my Sister Frances Allen deceased to and for his own use and benefit absolutely and do direct that the same maybe delivered to him as soon as conveniently may be after my decease   I give and bequeath to my Niece Sarah Smith the Daughter of my late deceased Sister Catherine Smith the legacy or sum of Nineteen Guineas to and for her own absolute use and benefit to be paid her within six Calendar Months after my decease   Next I give devise and bequeath all those my Messuages Lands Tenements Hereditaments and Real Estate whatsoever situate at Hanslope aforesaid or elsewhere which I may be seized or possessed of at the time of my decease and also all my Monies Securities for Money Goods Chattels Stock in Trade and all the rest and residue of my personal Estate and Effects whatsoever not hereinbefore disposed of unto my two friends Charles Crick of Hanslope aforesaid Baker and Joel Cox of the same place Farmer their Heirs Executors Administrators and Assigns according to the nature and quality thereof  respectively Upon the Trusts following (that is to say) Upon Trust that they my said Trustees or the Survivor of them or the Heirs Executors or Administrators of such Survivor do and shall as soon as conveniently may be after my decease sell and convert into Money all such parts of my personal Estate as shall not consist of ready Money or Securities for Money and collect all Debts due and owing to me at my decease and sell and dispose of all my said Real Estate either together or in parcels and either by Public Auction or Private Contract with full power to buy in the same at any such Auction or Auctions and afterwards to sell the same either by Public Auction or Private Contract for the best price or prices that can be reasonably obtained for the same And I do hereby direct that my said Trustees or Trustee for the time being shall stand possessed of the net monies arising from such Sale conversion and collection of my said Real and personal Estate Upon Trust in the first place to pay all my just Debts and funeral and Testamentary Expenses and the aforesaid Legacy of Nineteen Guineas to my said Niece Sarah Smith and as to the residue of such Monies Upon Trust to divide the same into three equal parts or shares and to stand possessed of the same respectively Upon the Trusts hereinafter declared  that is to say As to one third part or share thereof Upon Trust to pay and divide the same unto and equally between my three Nieces Sarah Smith Louisa Aldridge Widow and Elizabeth Smith the Daughter of my said late deceased Sister Catherine Smith To and for their own respective use and benefit absolutely to whom I give and bequeath the same accordingly As to the one other third part or share thereof Upon Trust to invest the same at Interest Upon Government or Real Security in England with full power to alter vary and transpose the same from time to time as my said Trustees or Trustee shall think fit and to pay the annual proceeds thereof unto my Sister Mary Allen the Wife of Joseph Allen of Hanslope aforesaid Victualler for and during the term of her natural life And I direct that the Receipt of the said Mary Allen or of the person to whom she shall from time to time appoint the same to be paid shall notwithstanding her coverture be a sufficient discharge to my Trustees for so much of the annual proceeds as shall be therein expressed to be received And from and immediately after her decease Upon Trust to pay and divide the Capital of the said last mentioned Trust premises unto and equally between my Niece Charlotte the Wife of John Brooks of Hanslope aforesaid Farmer Daughter of my said Sister Mary Allen and William Allen the natural child of my Niece Ann Allen deceased also Daughter of my said Sister Mary Allen to and for their own respective use and benefit absolutely To whom I Give and bequeath the same accordingly   And as to the remaining third part or share thereof Upon Trust to pay and divide the same unto and equally between my Nephews Thomas Allen and William Allen and my Niece Lucy Allen the Sons and Daughter of my said Sister Frances Allen deceased to and for their own respective absolute use and benefit To whom I Give and bequeath the same accordingly And I do hereby declare and direct that in case any of the Legatees entitled by this my Will to any portion or share of any one of the third parts or shares into which the net monies arising from my said Real and personal Estate are directed to be divided shall happen to die in my life time and shall leave lawful Issue him or her surviving such Issue shall take the share as well original as accruing by virtue of this present clause of his or her parent if more than one equally to be divided between them but in case there shall be no such Issue or being such shall all die in my life time Then I direct that the portion or share of the Legatee so dying as aforesaid shall go to and be equally divided amongst the surviving Legatee or Legatees of such third part or share or his or their Issue such last mentioned Issue taking only the part or share which his or their parent or parents would have been entitled to if living at my decease And in case any person becoming entitled under this my Will to any part or share of the monies arising from my said Real and personal Estate shall at the time of my decease or at the time when such part or share shall be payable be under the age of twenty one years Then I direct my said Trustees to lay out and invest the part or share of such person upon Government or Real Securities in England at Interest with power to alter vary and transpose the same when and as they my said Trustees shall think fit and to pay and apply the annual proceeds thereof when and as the same shall become due and payable unto for and towards the maintenance education and bringing up of such person during his or her minority Provided always and I hereby declare that the Receipts or Receipt of my said Trustees or the Survivors of them his Heirs Executors or Administrators to the person or persons who shall become the purchaser or purchasers of my said Real and personal Estate or any part thereof for his her or their purchase money or any part of the same shall be an effectual discharge for so much money as in every such Receipt shall be expressed to be received and that after taking such Receipt such purchaser or purchasers shall not be obliged to see to the application or be answerable or accountable for the misapplication or n on application thereof Provided also that my said Trustees respectively and their respective Heirs Executors and Administrators shall in nowise be answerable or accountable for the Acts and Receipts of the other or others of them nor for any loss or damage which may happen in the execution of the aforesaid Trusts without their own default but each of them for himself only and his own Acts and defaults only And that is shall be lawful for them my said Trustees respectively and their respective Heirs Executors and Administrators to deduct and retain and allow to his and their co trustee out of the monies which shall come to their hands respectively by virtue of the Trusts aforesaid all costs Charges and Expenses which they respectively may sustain or be put unto in the execution of the aforesaid Trusts or anywise in relation thereto And I hereby nominate and appoint the said Charles Crick and Joel Cox joint Executors of this my Will And hereby revoke all former Wills by me at any time heretofore made and declare this to be my last Will and Testament In Testimony whereof I the said Thomas Billing the Testator have to the first three sheets of this my last Will and Testament set my hand and  to this fourth and last sheet thereof my hand and Seal this twelfth day of July in the This is a Codicil to the last Will and Testament of me Thomas Billing of Hanslope in the County of Bucks Carpenter dated this twelfth day of July one thousand eight hundred and thirty six   Whereas I have in and by my said Will directed one third part or share of the residue of the monies arising from my said Real and personal Estate to be divided equally between my Nephews Thomas Allen and William Allen and my Niece Lucy Allen the Sons an Daughters of my Sister Frances Allen deceased and whereas Robert Allen Father of the said Thomas Allen was indebted to me in the sum of one hundred pounds Now I do hereby direct that sum of one hundred pounds shall be deducted and retained by my Executors from and out of the share of the said Thomas Allen of and in the third part or share directed to be divided as aforesaid and considered as part of my personal Estate and divisible accordingly And in all other respects I do hereby confirm my said Will In testimony whereof I have hereunto set my hand and Seal this twelfth day of July in the year of our Lord one thousand eight hundred and thirty six – Thomas Billing (LS) signed sealed published and declared by the said Thomas Billing the Testator as and for a Codicil to his last Will and Testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as Witnesses Joseph Hutchings George Peach John Parrott Junior
